Terms of Service
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY. BY PLACING AN ORDER, YOU AGREE TO BE BOUND BY THESE TERMS.
By placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
You are entering into an agreement with Once Upon a Bouquet LLC to create a unique, handcrafted product using vegetative materials. Due to the nature of these materials, each product will be distinct and may differ from your original fresh floral bouquet. You acknowledge and accept these variations.
1. I understand and agree that I am fully responsible for labeling, shipping, and covering all costs to deliver my bouquet to Once Upon a Bouquet's studio in Reston, VA. Once Upon a Bouquet LLC is not responsible for any loss, delay, or damage to my bouquet during shipping. I expressly waive any and all claims for compensation, replacement, or refund arising from issues that occur before the bouquet arrives at the studio.
2. I will ship my bouquet within three (3) days of the event to ensure optimal preservation. The final quality depends on the condition of the flowers upon arrival. Once Upon a Bouquet is not responsible for the state of the flowers upon delivery.
3. If I fail to ship my bouquet within three (3) days of my event date, I understand that Once Upon a Bouquet may cancel my order and refund my payment minus a $100 withholding fee.
4. If my flowers arrive in an unusable condition, Once Upon a Bouquet will notify me and either discard them or return them at my expense. I may replace the flowers for
an additional fee or receive a refund minus a $100 withholding fee. Once Upon a Bouquet reserves the right to refuse flowers that are too damaged or wilted for successful preservation.
5. If I cancel after booking but before sending my flowers, I understand that a $100 non-refundable fee will be retained. No refunds are given once preservation has begun.
6. Once Upon a Bouquet is not liable for any failure or delay in performance, or for any loss or damage, resulting from Acts of God, natural disasters, pandemics, labor strikes, transportation interruptions, supply shortages, war, government actions, or power outages. Additionally, Once Upon a Bouquet is not responsible for any loss or damage occurring in transit, or for issues arising from changes to the shipping address after it has been confirmed at checkout.
7. The client is responsible for providing accurate information, including shipping address, flower contents, and selection of frame styles. Once Upon a Bouquet is not responsible for errors due to incorrect or incomplete information.
8. A signature is required upon delivery due to the frame's value. To waive this requirement, I must email Once Upon a Bouquet prior to shipment.
9. Not all flowers will be used. Flowers may be excluded due to thickness, poor condition, unsuitability for pressing, or limited space in the frame, and will be discarded without return. Decorative items sent with my flowers will also be discarded and not returned.
10. Pre-dried flowers cannot be pressed or guaranteed for preservation.
11. Flowers may change in appearance—including variations in color, shape, and texture—during the pressing process. All pressed flowers may fade over time.
12. Once Upon a Bouquet may color correct certain white and light pink flowers at its discretion. Color correction is an optional add-on that may reduce the appearance of fading but does not guarantee the prevention of browning or an exact color match with the original bouquet.
13. By placing an order, I grant Once Upon a Bouquet permission to use images of my
finished frame and any shared photos for marketing and social media. Once Upon a Bouquet retains all copyright and intellectual property rights to all frame designs, layouts, styling, photos, and marketing images created in connection with your order. If you do not wish for your frame to be used in marketing or social media, please notify Once Upon a Bouquet in writing (via email) at the time of placing your order.
14. I grant Once Upon a Bouquet full creative liberty to design the frame as they see fit. I will receive a design draft via email for my approval. I may request up to two (2) revisions at no charge. Additional revisions will incur a $50 fee per revision. I acknowledge that the design draft is a general concept, not an exact replica of my bouquet.
15. Once I approve my design draft, my frame is considered finalized. No further changes can be made, including to frame color, type of glass, backing, or any other component.
16. I understand that the gluing process may cause slight movement or shifting of the flowers. As such, the final piece may not exactly match the design draft. The artist will use their discretion to make final adjustments for the best overall appearance.
17. Once Upon a Bouquet meticulously cleans and seals floating glass frames to minimize dust and particles. However, due to the natural properties of flowers—including pollen and small fragments—minor flaking or particles may still be present. Floating frames are permanently sealed to preserve the artwork.
18. Once the preservation process begins, my blooms cannot be returned unless included in the final framed piece.
19. If I order more than one frame, I am responsible for sending additional flowers beyond my original bouquet to accommodate multiple frames.
20. Once Upon a Bouquet will design my bouquet using the frame size I booked. If the frame appears too large, I may request the addition of more flowers during the design mockup approval stage. Additional flowers will incur an extra charge.
21. The estimated timeframe for the completion of my preserved frame is approximately 5–9 months from the date Once Upon a Bouquet receives the bouquet in a usable condition and confirms the order has entered the preservation phase. I understand that floral preservation is a time-intensive art.
22. Due to the custom and handcrafted nature of our work, all sales are final. No refunds are available once the preservation process begins.
23. Your pressed flower frame is a delicate, handcrafted art piece intended for indoor display only, away from direct sunlight. To preserve its quality and beauty, please avoid placing it in direct sunlight, high-humidity environments (such as bathrooms), or near heat sources. Once Upon a Bouquet LLC is not responsible for any fading, warping, or deterioration resulting from improper storage or display conditions.
24. Once Upon a Bouquet is not responsible or liable for any injuries or damages arising from the handling, installation, display, or other use of its products, including but not limited to those caused by broken glass or sharp edges. Customers assume all risk associated with unpacking, mounting, or using the finished artwork.
25. Under no circumstances shall Once Upon a Bouquet LLC, its owners, or employees be liable for any indirect, special, incidental, punitive, or consequential damages, or for any penalties—regardless of the legal basis of the claim, whether in contract, negligence, warranty, strict liability, statute, or otherwise—even if such damages were foreseeable or known. Once Upon a Bouquet LLC’s total liability under this agreement shall be limited to the amount I paid for the product or service, minus the $100 withholding fee, or the actual proven damages, whichever is lower. This remedy is my exclusive remedy, and these limitations apply even if the provided remedy fails to fulfill its intended purpose. Customer acknowledges that floral preservation is a sentimental process, but any damages arising from emotional distress or sentimental value are expressly excluded.
26. To the fullest extent permitted by law, Once Upon a Bouquet LLC expressly disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or warranties arising from custom, trade practice, or course of dealing, whether imposed by fact or operation of law.
27. Any claim for damages under this agreement must be submitted in writing via email to Once Upon a Bouquet LLC within ten (10) days of product delivery. Failure to submit a timely written claim will constitute a waiver of that claim. Claims must be submitted via email to the address provided at the time of order confirmation. Customers are responsible for using the most current contact information provided on our website.
28. Applicable sales tax will be added to all purchases in accordance with local and state laws. Once Upon a Bouquet LLC collects Virginia sales tax on taxable orders as required.
29. If Once Upon a Bouquet LLC incurs legal expenses in connection with efforts to collect amounts due under this agreement or to defend against claims, the company shall be entitled, to the fullest extent permitted by law, to recover reasonable legal fees and associated costs. These terms are governed by the laws of the Commonwealth of Virginia. Any disputes shall be resolved in Virginia courts.
30. Customer agrees not to initiate a chargeback or payment dispute without first contacting Once Upon a Bouquet LLC to resolve the issue. If a chargeback is initiated in violation of this agreement, Once Upon a Bouquet LLC reserves the right to dispute the claim and recover all associated costs, including legal fees.
31. If any provision of this agreement is found to be invalid or unenforceable for any reason, that provision shall be deemed severed from the agreement. The remaining provisions shall continue in full force and effect, and the agreement shall be enforced as if the invalid provision had never been included.
32. This Terms of Service agreement constitutes the entire agreement between the customer and Once Upon a Bouquet LLC and supersedes any prior discussions, promises, or representations, whether oral or written. No amendment or waiver will be valid unless made in writing and signed by both parties.
